On Friday, March 16th, 2012, President Barack Obama signed an executive order that asserts his authority to take over all food resources in the nation so long as it is done “to promote the national defense under both emergency and non-emergency conditions.” Can that qualifying phrase be any more ambiguous?
Obama has claimed this authority for himself and all future Presidents based on the fact that the President is “Commander in Chief” of the U.S. military. Essentially, this means that should the President ever deem it a matter of national defense, the U.S. government can now forcibly claim control of all your privately held crops, seeds, farm equipment, and livestock.
Think I’m exaggerating? Read the Executive Order.
Here’s the full text of the Executive Order. Perhaps the most pertinent parts to the discussion of food security are these:
Sec. 201. Priorities and Allocations Authorities. (a) The authority of the President conferred by section 101 of the Act, 50 U.S.C. App. 2071, to require acceptance and priority performance of contracts or orders (other than contracts of employment) to promote the national defense over performance of any other contracts or orders, and to allocate materials, services, and facilities as deemed necessary or appropriate to promote the national defense, is delegated to the following agency heads:
(1) the Secretary of Agriculture with respect to food resources, food resource facilities, livestock resources, veterinary resources, plant health resources, and the domestic distribution of farm equipment and commercial fertilizer;
(2) the Secretary of Energy with respect to all forms of energy;
(3) the Secretary of Health and Human Services with respect to health resources;
(4) the Secretary of Transportation with respect to all forms of civil transportation;
(5) the Secretary of Defense with respect to water resources; and
(6) the Secretary of Commerce with respect to all other materials, services, and facilities, including construction materials.
(b) The Secretary of each agency delegated authority under subsection (a) of this section (resource departments) shall plan for and issue regulations to prioritize and allocate resources and establish standards and procedures by which the authority shall be used to promote the national defense, under both emergency and non-emergency conditions.
Sec. 801. Definitions. In addition to the definitions in section 702 of the Act, 50 U.S.C. App. 2152, the following definitions apply throughout this order:
(c) “Farm equipment” means equipment, machinery, and repair parts manufactured for use on farms in connection with the production or preparation for market use of food resources.
(d) “Fertilizer” means any product or combination of products that contain one or more of the elements nitrogen, phosphorus, and potassium for use as a plant nutrient.
(e) “Food resources” means all commodities and products, (simple, mixed, or compound), or complements to such commodities or products, that are capable of being ingested by either human beings or animals, irrespective of other uses to which such commodities or products may be put, at all stages of processing from the raw commodity to the products thereof in vendible form for human or animal consumption. “Food resources” also means potable water packaged in commercially marketable containers, all starches, sugars, vegetable and animal or marine fats and oils, seed, cotton, hemp, and flax fiber, but does not mean any such material after it loses its identity as an agricultural commodity or agricultural product.
(f) “Food resource facilities” means plants, machinery, vehicles (including on farm), and other facilities required for the production, processing, distribution, and storage (including cold storage) of food resources, and for the domestic distribution of farm equipment and fertilizer (excluding transportation thereof).
(j) “National defense” means programs for military and energy production or construction, military or critical infrastructure assistance to any foreign nation, homeland security, stockpiling, space, and any directly related activity. Such term includes emergency preparedness activities conducted pursuant to title VI of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. 5195 et seq., and critical infrastructure protection and restoration.
The language is quite far-reaching while being stunningly precise.
So, what is an Executive Order?
The first president to use an Executive Order was George Washington. His order was about his household expenses, which were being remanded to the U.S. Treasury for payment.
At their root, these orders were created as a way for presidents to execute the laws passed by Congress. They served as directives to the different government agencies responsible for implementing particular laws.
Nothing harmful there, right? Seems pretty innocuous?
I would think so. At least, that is, until President Woodrow Wilson actually used an Executive Order to create a law in 1916. He called it an “emergency measure” and asked Congress to validate it, which they later did.
Since then, Presidents have increasingly used Executive Orders to actually make laws, completely bypassing the proper, Constitutional role of Congress.
Should you be concerned?
Here’s the deal. There are now thousands of these Executive Orders on the books. They’ve been written by Presidents of both parties, each one building on and giving the executive branch (i.e. the President) more power than is Constitutionally permissible. Reading them is like reading about how Mao or Hitler came to power.
There are Executive Orders on the books that allow the government to:
- take over all modes of transportation and control of highways and seaports,
- seize and control the communication media,
- take over all electrical power, gas, petroleum, fuels and minerals,
- mobilize civilians into work brigades under government supervision,
- take over all airports and aircraft, including commercial aircraft,
- relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations,
- increase domestic intelligence and surveillance of U.S. citizens,
- restrict the freedom of movement within the United States,
- isolate large groups of civilians, and more!
The part of me that’s prone to alarmist reactions wants to either flee to the hills or stick my head in the sand.
The good news is that the vast majority of these self-given, sweeping powers have never actually been implemented. Many of these self-appointed powers have been on the books as Executive Orders for at least 60 years in one form or another, and we have yet to have a President laugh maniacally while saying, “Aha! Now I’ll do what’s best for you and claim dictatorial control of absolutely EVERYTHING in the name of national defense.”
Basically, I’m pinning my hopes on the American people to continue to govern themselves and act in freedom even if their legislators or other governing bodies don’t want them to. Remember how last year that food buying club in Kentucky chose to IGNORE the Kentucky Department of Health’s so-called “quarantine” on their raw milk, and won?
Freedom is something we give ourselves, by choosing to act in liberty in the day-to-day minutiae of our lives. Sometimes, we have to fight for it by opposing particularly egregious legislation or standing up to over-zealous regulators. We may even have to go to jail for it through acts of civil disobedience. One day, we may even be called upon to die for it, and hopefully we’ll act according to conscience and do the right thing.

the big question I have is how are contracts defined as it’s applied here. that seems like it would drastically change how the rest is interpreted.
I’ve re-read through this E.O. three times now, and I’ve not seen anywhere where it defines “contracts.” So, we can add that in as one more level of ambiguity where the scope of action is left open to interpretation.
It is bothersome that it says that suppliers will be “required to accept” government contracts over any other contracts. It’s a complete interruption of the free market, all in the name of “national defense” even in “non-emergency conditions.”
Always be careful not to take text out of context! As far as executive orders are concerned, every President has used them; some with more regard to the Constitution than others. Remember, there is such a thing as impeachment and conviction.
You know, we can complain all we want about President Obama,(and there’s plenty to complain about; however,I think the most blame for him even being in office, let alone what he has done, falls directly on the shoulders of Christians who don’t vote and those who don’t even register!!! Any election could be turned if Christians got their heads out of the sand and their duffers to the polls on any given election day! We have noone to blame for these woes but Christians who don’t vote and those who voted for Obama!

Where did what I write contradict what’s in the Snopes article? I’m not saying this executive order granted the President “radical new powers.”
In fact, I went out of my way (when asking “Should you be concerned?”) to say that most of these Executive Orders have been re-stating the same thing in various ways for more than 60 years, and no President yet has actually implemented the vast majority of the provisions.
Who says Snopes is correct all of the time? What is it that guarantees Snopes is correct? Do they have some sort of license or qualifications that deem them to be right and credible 100% of the time? They have sources in their article about Obama, but sometimes even their sources are incorrect.
Food Renegade’s source is the actual executive order and I’m glad she wrote her article. Just because we live in America, doesn’t mean we can’t have our food freedoms taken away. Oh wait…food freedoms are already being taken away.
Who can guarantee that people who have food storage or a garden or animals won’t get into trouble with the government? Oh wait…that’s already happening too.

Snopes is NOT correct all of the time. In fact, their snipes on nutrition and natural health issues are particularly bad. On these topics, they get their “truth” from gov’t, Big Food, and Big Pharma. According to their own articles, the get their flu shots every year. (run a search on some of the topics on which you hold “alternative” views)
I do not generally consider snopes a credible source for anything more important than email chain letters.

Regardless of whether or not it’s utilized, legislation like this raises the sovereign risk of doing business in the US.
I don’t think this means what you think it means. From the sections you posted, it simply states that the president can delegate a power that congress has already given the president (per the code section it cites). Delegating power to parts of the executive branch is something that the president can already do. The Executive Order seems like a whole lot of nothing. Kind of like re-affirming your wedding vows. Nice but not necessary. The interesting/scary part might be the congressional legislation.
While it’s true that this E.O. is expanding on a piece of legislation from the 50’s, it is also true that this is the most recent in a string of them. (The last E.O. that expanded on this bit of legislation was written by Bill Clinton back in 1994.)
Each one progressively claims more authority. This most recent one by President Obama not only delegates authority to his cabinet heads, but it also expanded the language for what constitutes “national defense,” even including peacetime and “non-emergency conditions” in there.
Other sections of this particular E.O. also set up a new department in the Executive branch called the National Defense Executive Reserve. This new department is supposed to monitor people’s job history and qualifications and flag those who are skilled in desired fields so that they can work for the government in the event of national emergency. One subsection of that provision claims that one of the department’s new responsibilities is “to employ persons of outstanding experience and ability without compensation and to employ experts, consultants, or organizations.”
In other words, there’s A LOT of new stuff in this E.O., not just the delegation of authority to the Secretary of Agriculture in regards to food security.

I can tell just by the comments that my comments are among those written by very intelligent people, much more intelligent than myself. That being said, with my limited knowledge of anything legislative these E.O.’s have given me a funny feeling that Americans services of labor, resources, means to produce, etc. can be enslaved to the government as they seem fit. Am I completely off base here? It appears that the President (past Presidents included) has given himself (and any Presidents to come) the power to act upon what should be inalienable rights should they he ever see fit. Say for example if the American people ever revolt or try to “go off grid” as I have heard it put. Why do these E.O.s frighten me so? And should it?

Yes, you are r=getting the correct feeling. And you should be scared. Ask yourself: If these EO’s have been on the books for decades without need, shouldn’t they simply be repealed? If the executive branch were intended to have the power to bypass Congress in this way, why isn’t it in the Constitution? And WHY would these powers EVER be appropriate for a President to wield during a non-emergency, especially as they are all massive violations of the rights that are our birthright as human beings, delineated by the Constitution? (It may seem a small thing but it is important to remember that neither government nor the Constitution grants us rights. We have the rights, FIRST. The Constitution is supposed to give us government enough to deal with foreign affairs, interstate affairs, and defense, while restraining said government from violating the rights of citizens.

And for that woman who kept ranting about how this EO is simply authorizing the government to PURCHASE these necessary goods, did she miss the provision quoted above under Section 201 where it’s authorizing these agencies “to require acceptance and priority performance of contracts or orders (other than contracts of employment) to promote the national defense over performance of any other contracts or orders”?
Basically, it’s saying that if the government offers you a contract for those goods or services under the provisions of this EO, you will be required to accept it. What if it wants to pay a price that’s way under market? What about your right to say no and sell to whomever you want, or even keep the goods for yourself?

I think there are a lot of legitimate concerns. Talk to those who have lived in countries that had a government who controlled these things. Those who came to America because individuals had so much freedom. If my father were still alive, I know he would love to tell you. Please read the executive order, and think carefully about the ramifications. Do some research. I personally was very pleased with the fact that we had elected a man with President Obama’s race and ethnic background. In many countries this could not have happened. But I do not agree with his philosophies and policies. Does this mean I hate him? Absolutely not. I do not oppose him because of his race nor because of his party affiliation. I oppose his actions because they are detrimental to our country.

This is an intelligent article that simply states that presidents throughout history have signed E.O.s that give presidents powers that they would not normally have under the Constitution without them. I don’t know…..I realize being paranoid is probably a waste of time, but combine this nifty executive order with the NDAA he just signed a few months ago and I believe it could become a very scary combination. If you don’t know about the NDAA, you seriously need to check it out. In my opinion, it puts a whole new spin on everything.

Kristen,thank you so much for this article. My father grew up in Europe and lived under the Nazi regime. He shared stories of how Hitler gained control over so many people. I’m afraid we are headed down the same path. And to those who say that this is for our protection, I would say the best protection of a country is to keep the resources in the hands of the people. That is what makes a country strong. When we are dependent on a few people to care for our every need, we become helpless. We must take responsibility for ourselves.

Are you aware that this law has been around since 1950 and the Korean War? This is not some new law. All Obama did was slightly amend it and re-sign it. Do some research before trying to create a huge panic. And for those that let things like this get into a panic, do some research.

I am so sick of hearing about this EO as if its something new. Check out Executive Order 12919 of June 3, 1994 people. In fact here’s an excerpt for you:

Yes, this EO is almost identical to one signed by President Clinton back in 1994. But it represents the last in a long line of EOs which presidents have been using to expand on a piece of legislation passed in the 50s.

It didn’t take long for the Obama fanbois to come here to defend their dear leader. I wouldn’t bother answering them though as they clearly didn’t bother to read your article. They only reacted to the outrage of other Obama fanbois who also didn’t read the article.
Sure! They can try! If they can pass my property line and survive a shotgun blast to the face then yea they can have it. People are not going to just hand over everything they worked so hard for.

You only have one thing wrong here: Freedom is not something we ‘give’ ourselves. Freedom is an unallienable right, self-evident because of Natural Law, and endowed by Our Creator. Because this has been watered down by schools and media, we are in jeaopardy of loseing it. We as a Nation have turned instead to Government as our Giver of Freedoms, holding our breath and waiting to see if She will be benevolent or brutal. Our only hope is to stand firm on the Truths (self-evident) outlined by the Founders. If we see Tyranny rearing its ugly head, will we stand strong?

BTW: if you get a chance to see “FOR GREATER GLORY: the true story of the Cristero War”….you will be concerned about those idle Exec Orders. This is how Mexico leaders changed their Constitution, and waged an all-out Religious Freedm war against their own people. Be afraid….be VERY afraid!
If the country were to need the President to have that power in the event of a national crisis, and there is not really a precedent for it being used unnecessarily by previous Presidents, then what’s the problem? I know I felt alarmed when George W. Bush used Executive Privilege to an unprecedented degree to circumvent Congress, but the order you mentioned that Obama invoked doesn’t seem to be a problem.
You ought to watch Agenda: Grinding America Down. Curtis Bowers if you have not already. . It explains a lot of the craziness that is going on in the US that has been slowly infiltrated into our society by “communists” to actually bring America to its knees from the inside out. Obama is a huge pawn in their plan.

I really avoid getting into political discussions as I am the first to admit that I don’t understand most of it. But, after reading this article and some of the comments I went online to check something. Does it matter that the last info about the White House garden is in 2009? I keep reading articles such as yours and I can’t help but wonder why Mrs Obama is no longer pushing the home garden thing…
